Can Your HOA Limit Your Holiday Home Décor?

Are you planning to create a spectacular outdoor scene for your home this Halloween, Thanksgiving or Christmas? The holiday season is nearly upon us and we have begun to think about what kind of holiday cheer to put up this year!

For homeowners with strict HOAs, there might be some restrictions on what can and cannot be done on exteriors of properties.

Homes with HOA

Is it legal for an HOA to limit your home decoration? The answer is yes- they are allowed to regulate activities that might affect the neighborhood. Rules vary from neighborhood to neighborhood, so consider speaking to your HOA to see if there's any before investing in décor.

If you own a property that's a part of an HOA, it means you've agreed to abide by the rules established by the board. Do your homework before planning your holiday set up. The most common rule is the time following the holiday that decors can stay up. Some also prohibits decor that may offend anyone in your neighbor or the general public.

Homes without HOA

If you’re not tied to any HOA, you have the freedom to establish your own rules on your own property. Putting up any decor you want is a part of your First Amendment rights - freedom of speech.

However, just like your First Amendment rights, there are some limits, of course. If your decor can cause harm or can be a threat or intimidation to anyone in the neighborhood, it may land you in hot water.

Make Everybody Happy

But, hey! Holidays should be fun right? Nobody should get offended, harmed or hurt with your home decor because the general purpose of it is for everyone to enjoy the festive scene you worked hard on.

So, to make everybody happy, know your neighbors and find their sweet spot. You can talk to them and discuss your holiday decor plans. You may get more ideas too..

Some may say a classic look is the way to go; it should be palatable for everyone in the neighborhood. But it is up to you- let your creativity shine this season.
